CLARITY Act Misses Its Pre-Recess Window as Thune Reverses Course, Passage Odds Fall to 30%

Senate Majority Leader John Thune said on July 23 that passage of the Digital Asset Market Clarity Act before the August recess is unlikely, a direct reversal of Treasury Secretary Scott Bessent's declaration two days earlier that the bill was on the "1-yard line" with a floor vote imminent.
"I don't think we'll be able to get them done," Thune told reporters. "I would like to at least get Clarity started. We'll see where the votes are."
The statement collapsed what had briefly looked like a viable pre-recess path and moved prediction markets lower.
Why the Ethics Provision Is Still Blocking the Bill
The CLARITY Act needs 60 votes to advance in the Senate. Republicans hold 53 seats, meaning at least seven Democrats must cross over. Only two voted to approve the bill in committee. The ethics section governing Trump's crypto interests remains the last live obstacle.
As written, the bill limits enforcement of restrictions on senior officials' crypto activities to the Department of Justice, caps fines at $500,000, and lets the provision expire at the start of 2029. Democrats are demanding state attorneys general receive concurrent enforcement authority, a structural change the White House has declined to accept.
The concern driving that demand is structural: with Trump earning over $1.4 billion from cryptocurrency ventures since 2025, DOJ-only enforcement places oversight of presidential conflicts within the executive branch itself. Senator Elizabeth Warren put it plainly: "Donald Trump will simply ignore the law."
White House crypto adviser Patrick Witt, who helped negotiate the ethics deal announced earlier this week, pushed back on July 24. "I'm sorry, but you don't get to hit two home runs with one swing," Witt said, framing Democratic demands as overreach given the concessions already made. He added that he was "perplexed" by Thune's assessment and urged Democrats to "accept the victory they won."
What Stalls the Bill Stalls SOL's Regulatory Clarity
The CLARITY Act carries specific weight for Solana because it would formally classify SOL as a "digital commodity" under CFTC oversight, settling a jurisdictional question the SEC and CFTC have contested for years. That classification is not automatic under existing law; it requires Congress to pass this bill. SOL currently has 3.88 million on-chain holders, per Solana Compass, making the unresolved regulatory status a live question for a large holder base.
The longer the vote slips toward or past November, the more it competes with a midterm-shaped Senate calendar. It has already missed a July 4 target and a July 23 target.
Passage Odds at 30%
Galaxy Digital's Alex Thorn cut his estimate of the bill becoming law in 2026 to 30%, down from 50%, identifying July 30 as the practical last date to begin floor proceedings given the recess schedule. On Polymarket, where over $2.56 million has been wagered on the outcome, the YES probability sits at around 33%, down from peaks above 80% in February.
Ron Hammond, who leads policy at trading firm Wintermute, sees November midterms as the next realistic opening, arguing the bipartisan votes exist but are being suppressed by pre-election positioning.
Early August Has Not Been Ruled Out
The Senate is scheduled to remain in session briefly into early August before the full recess. Witt pointed to "that first week of August that the Senate is in session" as a period where a procedural start could still occur, even if a completed vote is not guaranteed.
Senator Cynthia Lummis, the bill's lead Republican negotiator, has indicated that contentious sections remain open to revision, a sign that talks have not fully broken down. A September window also opens when the Senate briefly reconvenes, though that session will compete for floor time with budget and defense legislation.
This is the second time in a month the CLARITY Act has reversed from apparent progress to stall. Republicans released an ethics-free draft that put the floor vote in jeopardy earlier this month, then the White House struck a new deal last week that briefly revived the timeline. The same underlying disagreement (who enforces the rules and with what teeth) has surfaced again.
