White House Agrees on CLARITY Act Ethics Deal, Sharing Terms with Senate Republicans
The White House agreed on a CLARITY Act ethics deal and shared terms with Senate Republicans, potentially enabling a Senate floor vote before August recess.
The White House has reached an agreement on an ethics package for the Digital Asset Market Clarity Act and has shared the terms with some Senate Republicans, Fox Business reporter Eleanor Terrett reported on July 20-21, 2026. The development closes the gap that had put a Senate floor vote in jeopardy four days earlier, when Republicans released a draft of the bill stripped of all ethics language.
Patrick Witt, executive director of the White House Crypto Council, wrote "Let's finish the job" on X in response to the news, according to Brave New Coin. Senate Majority Leader John Thune has committed to bringing the bill to the floor before the August recess, and the week of July 20 is the active target window.
What the White House Agreed To
The text of the ethics package has not been made public. According to reporting synthesized by Brave New Coin, the agreement was reached and shared with select Republican senators on July 20, with revised bill language expected in the coming days. Specifics of the compromise, including whether it addresses family members, existing holdings, enforcement mechanisms, or penalties, have not been confirmed from any public source as of this report.
The critical remaining step is getting those terms to the Democratic senators whose votes are required for passage. As of publication, the package has been shared with some Republican senators only, and has not yet reached Senators Ruben Gallego of Arizona and Angela Alsobrooks of Maryland.
Why Two Democratic Senators Hold the Key
Gallego and Alsobrooks voted for the bill in the Senate Banking Committee and have held firm to one condition: enforceable conflict-of-interest guardrails covering the President, Vice President, and members of Congress. The 60-vote threshold for Senate floor passage means the bill cannot advance without at least one of them.
Their position hardened after Trump's financial disclosures showed over $1 billion in crypto earnings in 2025, primarily from ventures including World Liberty Financial. CoinDesk reported that a high-level White House meeting was planned specifically to address this section of the bill, describing the provision as covering the legislation's restrictions on senior government officials' personal business interests in the crypto sector.
A July 16 Oval Office meeting that included Trump, Senators Bernie Moreno and Cynthia Lummis, and Witt ended without resolution. The Block reported that one source described Trump as unwilling to sign off on ethics language over concern that "any of these provisions could potentially harm him in the future," while a separate source characterized the talks as having progressed. The Terrett reporting on July 20-21 indicates a position was reached in the days following that meeting.
CLARITY Act Senate Vote Faces an August Recess Deadline
The Senate is scheduled to depart for recess after the first week of August. A floor vote that slips past that window risks delaying the legislative effort to 2027, given the compression of the congressional calendar in the fall.
For the Thune timetable to hold, the ethics text will need to reach Gallego and Alsobrooks, secure their agreement, and move through floor procedural steps within a matter of days. Revised bill language is expected shortly. Prediction market odds on passage improved after the Terrett reporting, according to Brave New Coin, from roughly 31% earlier in the negotiation period.
The Solana Ecosystem Stake
The Digital Asset Market Clarity Act draws a regulatory line between digital assets that function as investment instruments, which remain under SEC jurisdiction, and assets that power working networks, which would be classified as commodities under CFTC oversight. For Solana-native projects, the distinction carries direct practical weight.
Helium Network HNT$0.206+1.7% Helium Network, whose decentralized wireless infrastructure runs on Solana, made that case directly to Congress. Helium CLO Sarah Aberg testified before the House in support of the bill, citing the SEC's previously dismissed claims against HNT as evidence of why functional network tokens require commodity classification under the CFTC rather than securities treatment under the SEC. The CLARITY Act's commodity classification would reduce registration and compliance exposure under securities law for DePIN projects, DeFi protocols, and infrastructure token issuers across the Solana ecosystem -- a category that covers some of the network's most active builders.
What Gallego and Alsobrooks Still Need Before a Final Vote
The ethics package reaching Gallego and Alsobrooks is the immediate next step. If both senators find the White House compromise acceptable, the bill advances to the floor with the bipartisan support needed for passage. If they require revisions, the window tightens further.
Whether the language meets the standard those two Democrats actually set, specifically enforceable rather than aspirational restrictions, will determine whether the week of July 20 delivers a vote or another negotiating round.
