Bessent Says CLARITY Act Is at the '1-Yard Line' as Senate Eyes Vote This Week
Bessent put the CLARITY Act at the '1-yard line' July 21 with a Senate vote set for July 23. Democrats remain opposed over DOJ-only ethics enforcement.
Treasury Secretary Scott Bessent told reporters on Tuesday that the Digital Asset Market CLARITY Act has reached the "1-yard line" in the Senate, and Senate Majority Leader John Thune has separately expressed optimism about the bill's prospects. A floor vote is now expected during the week of July 23, with August 7 as the hard deadline before Congress heads to recess.
The CLARITY Act would establish a federal framework dividing regulatory jurisdiction over digital assets between the Commodity Futures Trading Commission and the Securities and Exchange Commission, with classification turning on the degree of a network's decentralization. The bill has already passed the House and cleared the Senate Banking Committee in a 15-9 bipartisan vote in May. A Senate floor vote requires 60 votes, a threshold that forces at least seven Democratic senators to break with their caucus, given Republicans hold 53 seats.
White House agreement last week on ethics language was the development that put the bill back on the floor calendar. But the ethics provisions that reopened Democratic negotiations are also the ones now at risk of falling short.
Democrats' 60-Vote Math and the Enforcement Dispute
Several Democratic senators who voted for the bill in committee have not committed to a floor vote. Senators Angela Alsobrooks and Ruben Gallego fall into this category, with Alsobrooks citing financial crime provisions as "unfinished business." Senators Catherine Cortez Masto and Mark Warner have also been identified as holdouts, according to Yahoo Finance.
The specific objection blocking Alsobrooks is about who enforces the ethics provisions, not whether they exist. The current proposal places the Department of Justice as the sole enforcement body, an arrangement Democrats argue is structurally incoherent: the DOJ answers to the same president whose crypto income prompted the ethics restrictions. President Trump's 2025 financial disclosure showed more than $1.4 billion in cryptocurrency-related income, including approximately $800 million from World Liberty Financial, according to CryptoSlate.
Republicans stripped an alternative in June. Section 604 would have permitted state attorneys general to bring enforcement actions when the federal government declined to act; it was removed from the bill text. Senator Bernie Moreno confirmed that DOJ remains the only enforcement mechanism. Alsobrooks, according to CoinDesk, called the arrangement an "unserious offer."
Her precedent point carries weight: the STOCK Act has barred congressional insider trading since 2012 under the same federal enforcement model and, according to Coindoo, has produced zero prosecutions in 14 years despite documented violations.
The White House had not published the full revised legislative text as of July 22. Revised language must circulate publicly before a cloture vote can be scheduled.
What Passage Would Mean for Solana's Ecosystem
The Solana SOL$78.41-0.1% ecosystem has a direct institutional stake in the outcome. Solana Policy Institute CEO Miller Whitehouse-Levine placed the bill's 2026 odds of passage at 50%, according to Yahoo Finance, and the institute has been among the most consistent industry voices pushing for the legislation. Its advocacy has centered on the bill's commodity-securities classification framework alongside developer protections, including Section 604 provisions shielding non-custodial software builders that were ultimately stripped from the current text.
Helium Network HNT$0.204-4.1% is among the Solana projects with the most direct legal exposure to the regulatory jurisdiction question. Nova Labs, the company behind Helium, sent its chief legal officer to testify at the House CLARITY Act hearing earlier this month, arguing that its own dismissed SEC case illustrates why the industry needs a statutory framework rather than agency enforcement.
For SOL and Solana DeFi protocols, the bill would define the commodity-securities boundary for on-chain assets, replacing the enforcement-by-litigation posture the SEC has pursued through individual cases.
August 7 Recess as the Hard Deadline
Prediction markets priced the bill's 2026 passage at approximately 41% as of Tuesday, according to Yahoo Finance, up from lower readings during the deadlock before the ethics agreement. Independent analysts gave the bill between 50% and 70% odds of passing this year.
If the Senate does not vote before August 7, the next viable window is a lame-duck session after the midterm elections, a path with fewer legislative days and less political urgency. Bessent's public statement is an attempt to hold Democratic attention on the window that exists now. Thune has not publicly committed to holding the vote regardless of where Democratic support lands, and the gap between the "1-yard line" declaration and an actual floor result runs through the offices of senators who have not yet decided which side of the 60-vote line they will be on.
