Senate Schedules CLARITY Act Cloture Vote for September 15 as Final Text Adds Validator Safe Harbor
CLARITY Act final text released September 14 with 126 Democratic changes. Senate cloture vote on September 15 includes BRCA civil safe harbor for validators.
Senators Cynthia Lummis (R-WY), John Boozman (R-AR), and Tim Scott (R-SC) released a final version of the Digital Asset Market Clarity Act on September 14, 2026, ahead of a Senate cloture vote scheduled for Tuesday afternoon. The procedural vote to begin formal floor debate requires a 60-vote supermajority. If it passes, the final text will be introduced as an amendment in the nature of a substitute; if it fails, the bill cannot advance to floor debate in its current form.
126 Changes Incorporated Before the September 15 Vote
The final bill incorporates 126 substantive changes requested by Senate Democrats, according to the September 14 press release from Lummis's office.
The ethics provisions substantially adopt the Tillis-Gallego proposal. The President, Vice President, members of Congress, federal judges, and their spouses must divest significant crypto interests or place them in a blind trust. State attorneys general gain a formal enforcement role alongside federal law enforcement. President Trump voluntarily agreed to apply these restrictions to himself, per the press release.
The stablecoin section gives the Treasury Secretary new authority to restrict deposit flows tied to payment stablecoins, a circuit-breaker mechanism the sponsors frame as protection for community banks and small businesses from deposit flight.
The Blockchain Regulatory Certainty Act provisions were revised to shield developers from money-transmission registration requirements and establish a civil safe harbor for infrastructure operators. Criminal safe-harbor language under Section 1960 was stripped in final negotiations, narrowing the protection to the civil side.
Agriculture Committee additions include new consumer guardrails on affiliate trading and conflicts of interest on digital commodity exchanges. State consumer protection laws explicitly apply to these platforms, while existing CFTC authority over derivatives is preserved.
BRCA Civil Safe Harbor and Solana Validator Protections
The BRCA provisions directly affect Solana SOL$120.90-0.6% validators. Under the civil safe harbor in the final text, a network infrastructure operator processing transactions and participating in consensus would not be classified as a money transmitter under federal law for that activity alone. Validator and miner protections were expanded in the final text, giving operators clearer cover from money-transmission classification solely for running network infrastructure.
The Solana Policy Institute had urged the Senate in June to preserve the open-source developer shields in the BRCA provisions. The final text extends those protections and explicitly expands coverage for validators and miners, though the criminal-side protection under Section 1960 was removed during negotiations.
"After a year of intense daily bipartisan negotiations, this bill is ready," Lummis said. "This text is truly bipartisan and includes more than 120 of Democrats' demands. A no vote on Tuesday means opposing real ethics reforms on politicians' personal investments, handing American leadership in digital assets to our foreign competitors, and leaving Americans with zero protections in the digital asset markets. Democrats got what they wanted; now they need to take yes for an answer."
BlackRock, Fidelity, and the Path to 60 Votes
Institutional support comes from BlackRock, Fidelity, Franklin Templeton, Goldman Sachs, Charles Schwab, and SoFi. The National Fraternal Order of Police and the National Organization of Black Law Enforcement Executives back the bill. On the law enforcement side, the National Sheriffs Association and Majority County Sheriffs Association, whose member agencies cover more than 130 million Americans per the press release, both dropped their opposition after reviewing the final text, with sponsors crediting new law enforcement tools.
The underlying legislation passed the House in July 2025 with a 294-134 bipartisan vote, including 78 Democratic votes. The Senate Banking Committee approved it 15-9 in May 2026, per Lummis's press release. Tuesday's procedural vote is the next gate.
Lummis and her colleagues shelved the CLARITY Act until September in late July after Majority Leader Thune prioritized other floor business. The cloture motion was filed on August 8, per Bitcoin Foundation reporting. Advancing through Tuesday's vote requires at least nine Democratic senators to join all Republicans, assuming no Republican defections.
Chairman Boozman, who led the Agriculture Committee portion of the bill, said: "We cannot afford to wait any longer. This legislation is the result of more than a year of negotiations with our colleagues and conversations with stakeholders to get the details right."
